Terms of Service

1. Agreement

These terms govern your use of Gladhear, provided by [COMPANY NAME] (“we”, “us”), contact [CONTACT EMAIL - placeholder hello@gladhear.com; owner must set up this mailbox]. By creating an account or using the service you agree to them on behalf of yourself and the business or agency you represent, and you confirm you have authority to do so. 2. The service

Gladhear helps local businesses (home-service companies, dental and other healthcare practices, and others) draft replies to public online reviews and create review-request links and QR codes. It generates drafts with AI, checks them with automated rules, and routes them to a person you designate for approval. Nothing is published on your behalf without a human approving that specific reply. Posting to Google is either manual (you copy the reply) or, if you connect Google, only after your approval and an explicit “Post to Google” click. The service is currently pre-launch/early access and provided “as is”; features may change.

3. Your responsibilities

• You are the publisher. You are responsible for every reply you approve or post, and for making sure it is accurate, lawful, and consistent with your professional obligations, Google’s policies, and privacy law. AI drafts and our safety checker can be wrong: read every reply before approving.
• No patient health information. Do not paste, upload or send PHI or other private health information. Gladhear is not HIPAA-certified and we do not sign Business Associate Agreements. You must not use the service in a way that would make it a business associate of your practice.
• Authority. You may connect only Google Business Profile locations you own or are authorised to manage. If you are an agency, you must have each client’s written authorisation before adding their location, and you must be able to show it on request.
• Review requests. Do not offer incentives for reviews, and do not screen or “gate” who is asked to leave a review. Follow Google’s review policies and any laws about soliciting reviews. Review links we create send everyone to the same destination.
• Accounts. Keep credentials and approval links private; you are responsible for activity under your account and for the people you appoint as approvers.
• Acceptable use. No unlawful, deceptive or abusive use; no attempts to break, overload or bypass limits of the service (including the free tool); no reselling or giving others programmatic access to our systems or to our Google Cloud project; no use to create fake reviews or fake engagement.

4. Google integration

If you connect Google, you authorise us to access your Business Profile data as described in the Privacy Policy and Google API data use page. You must also comply with Google’s terms (including the Business Profile API terms and policies). Google may change or withdraw API access at any time, which may limit or end this feature; that is not a breach by us. Data from Google’s API is stored only temporarily and deleted automatically, so it will not be available as a permanent archive — export what you need elsewhere.

5. Plans, trial and payment

6. Your content and our rights

You keep ownership of the review text, settings and replies you provide. You grant us a limited licence to host, process and transmit them (including sending them to our service providers) only to operate the service for you. The Gladhear software, prompts, checker rules and branding belong to us. Reviews on Google belong to their authors and to Google under Google’s terms; we do not claim any rights in them.

7. Free tool

The free reply generator is provided without warranty, limited per visitor, and may be changed or removed at any time. Do not enter private health information. We do not store what you enter (see the Privacy Policy).

8. Disclaimers

The service is provided “as is” and “as available”. To the maximum extent permitted by law we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy of AI output, uninterrupted or error-free operation, and that drafts will comply with any law, professional rule or platform policy. Gladhear does not provide legal, compliance or medical advice. Gladhear is independent and is not affiliated with, endorsed by, or sponsored by Google.

9. Limitation of liability and indemnity

[LEGAL REVIEW REQUIRED] To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data; our total liability for claims relating to the service is limited to the amount you paid us in the 12 months before the claim (or USD 100 if you paid nothing). You will defend and indemnify us against third-party claims arising from replies you approved or posted, your content, your breach of these terms, or your lack of authority over a connected location. Some jurisdictions do not allow certain limits; nothing here limits liability that cannot be limited by law.

10. Suspension and termination

You can stop using the service and delete your account at any time in the app. We may suspend or terminate access for breach of these terms, non-payment, legal requirements, or risk to the service. On termination we delete your data as described in the Privacy Policy.

11. Changes, governing law, contact

We may update these terms by posting a new version and, for material changes, notifying you by email; continued use after the effective date means acceptance. Governing law and venue: [JURISDICTION].
